Man Arrested for Illegally Manufacturing Fireworks

A 23 year old Fort Myers, Florida man was arrested for illegally manufacturing fireworks in his apartment.

The man was charged with 25 counts of possession/manufacturing an explosive device, 1 count of possessing explosives without a license, and 1 count of culpable negligence. The investigation and sting started around 11:30 in the morning. Two of the buildings at the apartment complex were completely evacuated. The residents were not allowed to return to their homes until after midnight.

The Fort Myers Fire Department HazMat team, the Southwest Florida Regional Bomb Group, and the Fort Myers Police Department all participated. The Red Cross provided help to people who were forced out of their homes.

Man Killed by Elevator in Connecticut

A 64 year old maintenance worker was killed in Derby, Connecticut when an elevator hit him on the head.

The man was working in the elevator shaft at the time of the accident. Authorities with the company are not quite sure what he was doing when the elevator fell.  The man had worked for the company for 30 years.

Police, as well as OSHA, are investigating the workplace accident. The man was hit on the head and pronounced dead on the scene. The elevator is small and not intended for human use.

Tire Defects Linked to China

Imported tire stems are said to have the potential to cause numerous dangerous tire failures across the country this summer. The stems are shown to crack prematurely which causes the entire tire to be useless.

The stems in question were sold on tires between September 2006 and June 2007. The defective stems have already been blamed in one lawsuit filed in Florida. In that accident, the driver of a vehicle was killed when his tires failed due to a defective valve stem.

One importer has already issued a recall for the valve stems. The National Highway Traffic Safety Administration is looking into the situation and has issued an advisory.

NJ High Court: Vioxx Manufacturer Not Responsible for Medical Monitoring

The New Jersey Supreme Court ruled Wednesday that Vioxx manufacturer Merck & Co. is not responsible for medical monitoring for Vioxx users not claiming injury by the drug. The ruling invalidates a class action suit against Merck brought by users of the drug Vioxx, claiming that, although they have not yet suffered any known ill effects, their use of the products put them at higher risk of developing health problems in the future. The suit sought to force Merck to pay for medical monitoring under NJ’s Product Liability Act.  In a 5-1 ruling, the high court rejected this line of argument, saying that, without a claim of injury, plaintiffs do not qualify for coverage under the Product Liability Act.

Vioxx was pulled off the market in 2004 after studies showed it doubled the risk of heart attack and/or stroke. Merck has already agreed to pay nearly $5 billion to settle thousands of personal injury suits linked to the drug.

FDA Plans New Drug Labels for Pregnant Women

Plans for the Food and Drug Administration’s (FDA) new drug labeling system were announced recently. The new labels, which have been in the works for over a decade, are intended to be easier to understand and provide more information about the possible effects of prescription medicine on pregnant women and their infants.

The current system, says the FDA, is confusing, overly generalized, and does not facilitate the addition of updated information as it becomes available. Under the new labeling system, drugs would be categorized by letters denoting the potential risk it would pose to pregnant women. Furthermore, sections summarizing the effects of the drug on a fetus and breast-fed infants, as well as information regarding the drug’s usage in studies and other clinical considerations, would be added to the labels.

Family of Boy Injured During Arrest Intends to Sue

The family of a teenage boy who suffered broken bones and internal injuries during an arrest intends to sue for damages. Juan Vasquez, 16, sustained broken ribs, a lacerated liver, and kidney damage following a foot chase by Officer Charles Porter of the Denver police.

According to two other Denver officers, Porter was seen jumping on Vasquez’s back at least 4 times. Porter has been suspended without pay since the incident and may face second-degree assault charges.

Vasquez’s family told a reporter that they want $1.3 million from the city, but their attorney denied that any figure had been determined.

School Injury Lawsuit Settled for $70k

A lawsuit filed against a New Jersey school by the family of a girl injured during gym class was settled for $70,000 recently. In September 2003, the girl, whose name was not disclosed, was exercising on a school running path when she allegedly fell due to a hole in the path, severely injuring her right foot and ankle.

The lawsuit, which named Pittsgrove Middle School, the local Board of Education, and the girl’s gym teacher as defendants, alleged that the defendants had negligently failed to maintain the running path or warn the students of dangerous conditions.

Connecticut Woman Sues Husband for Eye Injury

A Connecticut woman has filed a lawsuit against her husband, saying that he was responsible for injuring her left eye during an argument.

According to the lawsuit filed by Pamela Vecsey, her left eye was permanently injured by a carrot that her husband, Roderick Vecsey, threw at her during an argument in 2006. The carrot punctured her left eyeball, which has now been replaced by a glass eye.

Pamela refused to cooperate with a criminal investigation against her husband. The couple still lives in the same house.

Woman Wins Settlement Against City, State in Street Light Collapse

An Aberdeen woman won a $450,000 settlement from the city and state in a lawsuit over injuries she sustained when a street light collapsed onto her car in 2006. Lacey Hicks received severe injuries from the accident, requiring surgery resulting in physical disability and limited range of motion.

A subsequent investigation found that the bolts at the base of the street light were rusted and structurally unsound, possibly contributing to the collapse.

Easter Toy Recalled
